1. Acceptance of Terms

By registering for or using the Viva Voters platform ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use the Service.

2. Description of Service

Viva Voters provides a secure online voting platform that allows organizations ("Administrators") to create and manage elections, register voters, and collect votes electronically. The Service is provided on a subscription basis with a free trial tier available.

3. Account Registration

• You must provide accurate and complete information when registering.
• You are responsible for maintaining the confidentiality of your account credentials.
• You must notify us immediately of any unauthorized use of your account.
• One account may represent one organization. Creating multiple accounts to circumvent trial limits is prohibited.

4. Trial Plan

The free trial plan is subject to the following limits:

• Maximum of 2 elections.
• Maximum of 20 voters across all elections.
• Maximum of 5 candidates per election.

Trial limits may be changed at our discretion with reasonable notice.

5. Acceptable Use

You agree not to use the Service to:

• Conduct fraudulent, illegal, or manipulated elections.
• Harvest, collect, or misuse voter personal data.
• Attempt to circumvent security controls, rate limits, or authentication mechanisms.
• Upload malicious code, viruses, or harmful content.
• Impersonate any person, organization, or entity.
• Violate any applicable local, national, or international law or regulation.

6. Data Responsibility

As an Administrator, you are the data controller for the voter information you upload to the platform. You are responsible for:

• Obtaining appropriate consent from voters before uploading their data.
• Ensuring voter data is accurate and up to date.
• Complying with all applicable data protection laws in your jurisdiction.

7. Election Integrity

Viva Voters implements technical controls to ensure election integrity including unique voter tokens, duplicate vote prevention, and full audit trails. However, the Administrator is responsible for verifying the accuracy of voter rolls and ensuring the legitimacy of the election process.

8. Payments and Subscriptions

• Paid plans are billed in advance on a monthly or per-election basis.
• All fees are non-refundable except where required by law or stated in our refund policy.
• We reserve the right to change pricing with 30 days' notice to existing subscribers.
• Failure to pay may result in suspension or termination of your account.

9. Intellectual Property

The Viva Voters platform, including its design, code, and content, is owned by us and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the Service for its intended purpose. You may not copy, modify, distribute, or reverse-engineer any part of the platform.

10. Limitation of Liability

To the maximum extent permitted by law, Viva Voters shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability to you for any claim shall not exceed the amount paid by you in the 12 months preceding the claim.

11. Termination

We reserve the right to suspend or terminate your account at any time if you breach these Terms of Service. You may close your account at any time by contacting us. Upon termination, your data will be deleted in accordance with our Privacy Policy.

12. Changes to These Terms

We may update these Terms of Service from time to time. We will notify you of material changes by email or by displaying a notice on the platform. Continued use of the Service after changes take effect constitutes your acceptance of the new terms.

13. Governing Law

These Terms of Service are governed by and construed in accordance with applicable law. Any disputes shall be subject to the exclusive jurisdiction of the competent courts in the relevant jurisdiction.
